1949년 이후 중국의 종교계는 중국 대륙에 사회주의 정권이 들어서며 새로운 국면을 맞게 된다. 종교계는 변화된 사회정치적 환경 속에 생존을 위한 타협점을 모색하게 되었으며 이러한 과정 속에서 각 종교의 특성에 따른 규장제도라는 틀 속에서 종교활동을 보장받게 되었다. 도교 또한 정부의 5대종교의 제도적 정비에 따라 이에 준하는 규장들이 만들어지고 그 규장은 중국도교의 조직적 체계와 신앙활동을 규정하는 핵심적 구속장치가 되어 종교활동의 당위성을 가름하는 기준이 되고 있다. 도교는 민간에서 자생한 토착 종교인데 종교집단로 성장하고 유지하는 과정에서 정치 권력과 길항관계를 통해 늘 자구책을 모색해왔다. 시대에 따라 권력의 보호를 받아 교세를 확장하는가 하면 때로 권력의 박해를 받아 교단이 위축되기도 하였다. 어쩌 면 도교의 계율은 이러한 상황논리를 가장 잘 반영하고 있는 산물이라 할 수 있다. 현재 도교가 처한 종교적 상황에서 도교 계율의 생성원리는 오늘날에도 시사하는 바가 크다. 이를 단적으로 보여주는 것이 개혁개방 이후 적극적으로 추진된 도교 관련 법규들이며, 이러한 도교협회의 규장제도를 통해 현재 중국 도교의 실태와 종교적 위상을 탐색해 볼 수 있다.
